Effective Date: August 15, 2025
1. Introduction
Welcome to ReviewNow.org ("ReviewNow," "we," "us," or "our"). We provide an automated platform (the "Service") to our business clients ("Clients") to facilitate the collection of customer feedback and the generation of online reviews from their customers ("End-Users").
This Privacy Policy is designed to inform you about how we collect, use, process, and disclose information, including personal data, in connection with your use of the ReviewNow Service. Protecting your privacy is a top priority, and we are committed to being transparent about our data practices.
2. Scope of this Policy
This policy applies to the personal data we process on behalf of our Clients. In this context, our Client is the "Data Controller," and ReviewNow.org is the "Data Processor." It also applies to data we collect directly from our Clients when they register for and use our Service.
3. Information We Collect and Process
We process different categories of personal information depending on your relationship with us.
3A. Information Provided by Our Clients About End-Users:
To initiate the feedback process, our Clients provide us with specific information about their End-Users with whom they have a pre-existing business relationship. This includes:
Personal Identifiers: Full Name and Mobile Phone Number of the End-User.
Transactional Information: Details related to the service or job performed for the End-User (e.g., "plumbing repair," "annual inspection").
Our Terms of Service require our Clients to warrant that they have a lawful basis (e.g., consent or legitimate interest) for providing this information to us for processing.
3B. Information Collected Directly from Clients:
When a business registers as a Client, we collect information necessary for account management, billing, and service provision:
Account Information: Business Name, contact person's name, email address, and phone number.
Billing Information: Payment details, billing address, and transaction history.
3C. Information Collected Automatically from End-Users:
During the interaction with an End-User via SMS, we automatically collect:
Communication Metadata: The End-User's mobile number, the date and time of messages, and message content (e.g., "YES" for consent, service ratings, and textual feedback).
Consent Records: A log of the End-User's affirmative consent ("opt-in") to receive messages, including the timestamp and phone number.
4. How We Use Information
Our use of personal data is strictly limited to providing and improving the Service.
To Operate the Service: We process End-User data on behalf of our Clients to send initial consent requests, engage in the feedback conversation, and provide links for review posting.
To Fulfill Contractual Obligations: To manage Client accounts, process payments, and provide customer support.
For AI-Powered Features: We use job details and End-User feedback in conjunction with third-party AI services to draft potential reviews (for positive feedback) or to summarize issues and suggest responses (for negative feedback). The data is used solely for this purpose within the context of the specific transaction.
To Maintain Compliance and Security: To enforce our Terms of Service, log consent as required by law (e.g., TCPA), and protect the security of our platform.
5. Information Sharing and Disclosure
We do not sell or rent personal information. We may disclose information to third parties under the following limited circumstances:
With Third-Party Service Providers: We engage trusted third-party companies to perform critical functions for our Service. These "sub-processors" are contractually obligated to protect data and use it only for the services they provide to us. They include:
Communications Platform (e.g., Twilio): To send and receive SMS messages.
Automation Platform (e.g., Make.com): To execute the automated workflow.
Artificial Intelligence Provider (e.g., OpenAI): To process textual data for review drafting and feedback summarization. We take steps to ensure that personally identifiable information is not used unnecessarily in prompts to our AI provider.
To Our Clients: We provide End-User feedback, ratings, and communication history directly to the Client on whose behalf it was collected.
For Legal Reasons: We may disclose information if required by law, subpoena, or other legal process, or if we have a good faith belief that disclosure is reasonably necessary to (i) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (ii) enforce our agreements with you; (iii) protect the security or integrity of our Service.
6. Your Rights and Choices
We are committed to facilitating data rights.
For End-Users:
Right to Opt-Out: You can withdraw your consent and stop receiving messages at any time by replying STOP, CANCEL, or UNSUBSCRIBE to any message.
Data Rights Requests: Because we are a Data Processor, any requests to access, rectify, or erase your personal data should be directed to the business (our Client) that initially provided your information to us. We will assist our Clients in responding to these requests.
For Clients: You have the right to access, update, or delete your account information through your account settings or by contacting us directly.
7. Data Security
We have implemented and maintain appropriate administrative, technical, and physical security safeguards to help protect the personal information we process from unauthorized access, use, or disclosure. We use encryption and other measures to protect sensitive information online and take steps to protect information offline.
8. Data Retention
We retain personal data for as long as necessary to provide the Service to our Clients and to comply with our legal obligations. Consent logs are maintained as a record of compliance. Data is securely deleted or anonymized when it is no longer needed.
9. Children's Privacy
The Service is not intended for or directed at individuals under the age of 18. We do not knowingly collect personal information from children.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify our Clients of any material changes by posting the new policy on our website and updating the "Effective Date."
